Exercise of the parental authority by one parent. A practical perspective

Summary/Abstract: This study provides a practical dealing with the subject of the exclusive parental authority to the reader, however, without sacrificing or mitigating the scientific and stylistic rigor. In addition to the dozens of the case decisions herein reproduced, intended to provide the practitioner with a useful work tool at hand, the article makes inroads including through the purpose/motivation considered by the legislator when enacting the rules in the matter, as for the author of these lines, as well, ratio legis est anima legis. Finally, we consider that the comparative law approach brings added value to the article, once the parallelisms carried out herein considered even the foreign laws which the legislator recognized as a source of inspiration, but also others, which (even if they have not been formally recognized) reveal a remarkable similarity with the domestic one.
