Summary/Abstract: The issue of regulating and protecting human rights has become much more significant with the development of the European Communities and the European Union. The Charter of the Fundamental Rights of the European Union was adopted in 2000 but for a long while after being adopted it was not binding on the Member States. The adoption of the Lisbon Treaty brought about significant changes in this respect but there were considerable dilemmas in terms of establishing the status of the Charter in relation to the Lisbon Treaty due to the specific legal technique of the cross-reference clause contained in Article 6 (1) of the Treaty on the European Union as well as in the formulation of Protocol 30 and the Declarations 53, 61 and 62 accompanying the Lisbon Treaty.
