CORRELATIONS BETWEEN THE RIGHT TO HAPPINESS OF THE CHILD FROM THE PERSPECTIVE OF THE RECOGNITION OF THE IMPRESCRIPTIBLE CHARACTER OF THE ACTION IN ESTABLISHMENT OF THE PATERNITY OF THE CHILD BORN OUTSIDE THE MARIAGE

Summary/Abstract: Starting from the sacramental transposition of the social reality, the writer Jose Saramago has extracted the essence - “All the fathers were sons, but some forgot what they were, as for the others, no one was there to explain”, view that makes us watch with responsibility the importance of the normative framework regarding imprescriptibility of the paternity action of the child born outside marriage, taking the communitary law in consideration, beyond the constant changes of the national law, bringing awareness to the importance to the father’s presence for the child’s civil and emotional identity.Recognising, beyond the era and legal regime, the imprescriptible character of all paternity actions we will ensure a fundamental component of the right to happiness of an individual.
