Summary/Abstract: The gloss refers to the decision of 16 October 2014, III CSK 301/13, in which the Supreme Court adopted the position that a member of the body of a legal person may, in principle, be a witness to making a testament in which any benefit is provided for that legal person. Similarly, in the opinion of the Supreme Court, a witness to making a testament may, in principle, be a member of a corporate legal person for which any benefit is provided in that testament. The author made a critical assessment of that position in the gloss. He considered as appropriate the view according to which a witness to making a testament in which any benefit is provided for a legal person cannot, in principle, be either an officer of such legal person, or any member (partner) of such corporate legal person.
