Summary/Abstract: Large case-load, expensive and time consuming proceedings are common problems of courts around the world, resulting in efforts to introduce ADR, especially for the resolution of the cross border disputes. In this paper, the author explains the process of institutionalization of international mediation, which can be viewed through the activities undertaken by the Council of Europe as well as the European Union. Likewise, through the analysis of the newly introduced provisions concerning the basic principles,the impact of mediation and the settlement enforcement options, the author points out the necessity of harmonization of domestic legislation with the legal framework of international mediation in the European Union.
