CONSIDERATIONS REGARDING THE VICTIM’S OR THIRD PARTY’S ACT, THE EXERCISE OF RIGHTS AND OTHER LIABILITY EXEMPTION CIRCUMSTANCES WITHIN THE NEW CIVIL

Summary/Abstract: The causes exempting liability were regulated in the new Civil Code, at art. 1351 – 1356, and the legislature was concerned regarding the causes that exclude the very existence of a causal relationship, as a necessary objective tort liability. Certain particular problems arise with regard to the victim’s or third party’s act, the exercise of rights and on other liability exempting causes.
