Summary/Abstract: As a consequence of Review Conference held in year 2010 in Kampala, crime of aggression was defined and regulations was made for the exercise of jurisdiction of International Criminal Court (ICC) over crime of aggression. The said regulations after the ratification by 30 State Parties shall be enforced after being adopted again by 2/3 majority by Assembly of State Parties. In the concept of preconditions to the exercise of jurisdiction of ICC over crime of aggression with Kampala regulations, some limitations were stipulated when compared to other crimes under the jurisdiction of ICC. Nonetheless, it has vital importance for the independence of ICC for prosecutors to commence investigation by the authorization of Pre-Trial Division for crime of aggression and ICC not to be dependent upon Security Council’s determination. In this manner, not only ICC’s independence was provided but also the monopoly owned by the Security Council for the issue of international peace and security and for the determination of acts of aggression are exterminated. Therefore, concessions owned by permanent members was wasted. And this is a major step for the development and maturation of international law.
