Summary/Abstract: The aim of this paper was to analyse the basic aspects of the scope and nature of the right to a fair trial in the European Union with particular regard to the dualistic right to a fair trial for citizens of the European Union, as well as to analyse one of the important principles, which is the principle of the state’s liability for damages, which plays a significant role in the process of ensuring effective judicial protection. It is a complex concept that cannot be easily defined, therefore, only some of its aspects have been discussed.
