Medical secret in the face of change

Summary/Abstract: The regulations of law and the norms of the Code of Medical Ethics regarding medical confidentiality, are of great importance both for the physicians themselves and for their patients. The provisions of these documents should also be known to law enforcement authorities, prosecutors, judges and lawyers. Given that they translate into specific procedural situations, they are also relevant in cassation proceedings before the Supreme Court. As it stands, the provisions on medical confidentiality after the patient’s death are associated with a serious danger to the patient’s rights. One can, of course, argue that the patient does not have any rights after death, but his/her will is normally respected in all civilised societies and the corresponding legal systems.
