Summary/Abstract: The article presents the problem of stalking and cyberstalking and offenses arisingfrom hate speech and attempted evaluation of the acquired legislation criminalizing thesephenomena. In the modern world stalking, cyberstalking, and hate speech are consideredbehaviors thaat constitute a serious violation of human rights including the right to liberty,privacy and dignity. Especially hate crime (hate crimes) are a serious problem for thedevelopment of society. Feeling of indulgence society can not tolerate behavior marked. Penalizacja zjawisk stalkingu...by tormented victims, their persecution on the Internet or the real world. We can not be indifferent to the promotion of racial, ethnic, religious hatred. General spread of intolerance towards other people undermines the idea of democracy, security and pluralism. Also, law enforcement agencies can not remain passive in relation to such offenses as violence and threat unlawfuly motivated by prejudice (art. 119 of the Penal Code), stalking (art. 190 a of the Penal Code), promotion of fascism and totalitarianism (art. 256 of the Penal Code), racism ( art. 257 of the Penal Code), insult of religious feelings (art. 196 of the Penal Code), defamation (art. 212 of the Penal Code) and insult (art. 216 of the Penal Code), although much depends on the attitudes of victims.
