Summary/Abstract: The complex character of the reforms of the Republic of Moldova political and legal system requests the participation of a great part of the population, taking into account that the country goes through a transition from a totalitarian regime to a democratic one. In this phase, an important role within the process of building the rule of law-based state is played by the direct democracy tools. To the Republic of Moldova, where, for a long time, the referendum has not been used, this type of research is particularly interesting. In this context, the article aims to evaluate the independence referendums which, in the constitutional scholarship, are not yet considered as a distinctive category. Following theoretical research, the author shows that such a referendum can be considered as legitimate only if it meets some fundamental requirements of constitutionality and legality.
