Summary/Abstract: The parents’ right to ensure the education of their children is an expression of freedom of conscience and of a democratic society. The right to education is not an isolated right but is interconnected with the other fundamental rights and personal freedoms enshrined in international human rights law. The obligation of states to protect and guarantee this right is achieved, on the one hand, by regulating different forms of education, and on the other hand by offering parents the possibility to intervene in the determination of the educational content. In Romania, the state guarantees three forms of education, namely state education, confessional education and private education, which was only possible after the 1989 Revolution, thus following the change of the governing system. This article will confine itself to analyzing the manifestation of freedom of conscience and the right to education in the pre-university private education sector in Romania.
