So called non statuory countertypes from the principle of determinacy perspective

Summary/Abstract: In the paper the Author describes issue of so-called non statuory justifications from the nullum crimen sine lege principle perspective. Firstly, the history and characterisation of this principle is presented. The main research aim of this study is to make an assessment of coherency between socalled non statuory justifications and the nullum crimen sine lege principle. That problem has caused many discrepancies in the literature. The Author makes this assessment using Polish and international law with special considerations on the criminal law function in the democratic state of law.
