Summary/Abstract: The main reason to analize the problem of the role of psychiatrists in criminal procedure was the Ombudsman’s raport about people who are mentaly ill and who were sentenced to prison. The author is looking for the reason of this problem, so checking the way of appointment psychiatrists, what they do, how and why. It is showed what way they are appointed and how much rigorous it is. It is discussed, that the institution is not perfect at all, there are essential mistakes of expert opinions and using they. Furthermore, the role of psychologists is so limited. The author points out the large problem of this kind of specialists and propose her point of view to find a solution of it.
