Summary/Abstract: This article examines the existence of a special clause called arbitratus de restituendo in the various actiones poenales of the Formulary process in order to ascertain which function is exercised by the opportunity given to the defendant to compensate the claimant ante sententiam, as this redistribution was already recognized by ab antiquo for some kind of the private delicts.
