Summary/Abstract: The article is devoted to the involvement of udices pedanei in the criminal proceedings. The author deals with the constitutions included in the Justinian Code: the Diocletian recription in relation to the documentary deception in the civil proceedings and a separate constitution for documentary fraud reconstructed in the Basilicas. The autore considers that the judges have incidental competence in the criminal and in civil processes on these issues under a special delegation from the magistrates.
