Summary/Abstract: The study is based on a subject, well developed in Roman law, the civil liability of the judge, which has it's importance today. Misconduct iudex privatus sanctioned by actio in factum in the classical period, until Justinian lawyers agree that this is quasidelictum. In this article, by presenting the main authors who have analyzed the topic, as well as exegesis of some fragments of the sources, an attempt is made to establish the content of the term "Litem suam facere", as well as it's legal nature and development in Roman law.
