GLOSSES AS PRINCIPLE IN THE SLAVONIC TRANSLATION OF THE PROCHEIROS NOMOS – A WRITTEN RECORD OF THE BYZANTINE INPERIAL LEGISLATION

Summary/Abstract: The Byzantine Procheiros Nomos, an official example of the secular jurisdiction from 870–879 г., has unclear and complicated history in Slavic environment. Integral Slavonic translation from the times of tsar Symeon (893–927) has not been preserved; in the Nomocanon of 14 titles, translated in Preslav, there are some excerpts from only three titles. The first material witness for the complete Slavonic translation of the Procheiros Nomos is the Serbian Kormchaya from Ilovitsa, 1262, where one can see the adapted appellation with which the juridical record has been introduced in the Slavonic tradition. However, Закон градски is not a loan from the Greek Πρόχειρος νόμος, but points its official character by putting accent on the typical for the Middle Ages town-centered paradigm of the Power. The article aims at presenting one text particularity, namely the high level of intertextual and marginal glosses in the Ilovitsa copy by classifying them in exhaustive and comprehensive data base. The study tries to answer the question why the process of creating glosses occurred to be a suitable form for explanations and commentaries on both unclear and essential juridical notions, and what kind of information about the translation history one can get on the basis of it. We consider this peculiarity of the translating technics as a clue leading to more elucidated view upon the specificities of the Ilovitsa Kormchaya, as well as upon the overall problematics of the Procheiros Nomos in its Slavonic translation and existence from the 13th century backward and onwards, until the Official printed version of Patriarch Nikon and Patriarch Yoasaf’s Church Slavonic Kormchaya, 1650–1653.
