Partnership or marriage? Evaluation of Deputies’ Bills – on Partnership and Introductory Provisions of the Act on Partnership

Summary/Abstract: In the author’s opinion, the proposed provisions – contrary to their nomenclature – introduce an institution of samesex marriages. Therefore they may be considered incompatible with Article 18 of the Constitution of the Republic of Poland. The proposed regulations regarding the dissolution of the partnership provide less protection to the children of partners than the children of one of them adopted by the other, what is inconsistent with the constitutional principle of equality. Besides the bills contain many legal shortcomings.
