Summary/Abstract: The increase of personal freedom makes important changes in family relationships between two parents and there are children. The actual legal order is not suitable to the special needs of the separated parental couple and the right to family life of each parent with their children. The tender years doctrine is exhausted and the doctrine of the shared parenting is the best solution for the needs of contemporary parents and children and at the first place is in the best interest of children.
