Summary/Abstract: The study of Roman superficies is mainly focused on the private aspects of its regulation. It’s also pointed out that the origins of superficies are as a concession of public lands owned by the Roman state, the minicipia or the church, and later are used in private relations. The article presents some of the main aspects of this public regulation. There are also suggestions on the need to overcome the principle "Superficies solo cedit", which is the basis of the modern legal framework, namely in connection with the construction on the public land.
