Legal aspects of the implementation of the tasks of the national institute of freedom – center for the development of civil society as an unit of the public finances sector

Summary/Abstract: Goal – The aim of the study is to present the results of the legal analysis of regulations included in the Act of 15 September 2017 on the National Institute of Freedom – the Center for Civil Society Development. The study is intended to assess legal regulations of the implementation of the tasks of the National Institute of Freedom in the light of the applicable law and the doctrine of public finance law. The basic research objective is focused on the analysis of legal and financial instruments serving the implementation by the National Institute of Freedom – Center for Civil Society Development of state policy in terms of civil society development, based on the principles of openness, competitiveness and transparency Research methodology – The research used methods of legal text analysis (formal and linguistic method and the logical method) as well as dogmatic and legal method. The context and legalcomparative method was also used to the extent necessary for legal analyses. The studies presented in the study concern (1) the legal status of the National Institute of Freedom as an executive agency, (2) the statutory tasks of the Institute and (3) the ways, forms and modes of their implementation, and (4) the legal aspects of financial management Institute. The subject of the analysis is the correspondence of particular legal solutions contained in the Act to other legal regulations and the achievements of science. Score – The results of the conducted research are (1) theorems describing the applicable legal status in the examined range, (2) theorems reconstructing the conceptual apparatus applicable to the subject, (3) the thesis assessing legal solutions, and (3) de lege ferenda postulates.
