Summary/Abstract: The Constitutional principle of human equality express their formal equality and the prohibition to discrimate equal people or, contrarily, to accord them privileges. However, formal human equality does not disprove their actual inequality and it even helps to occur for such. There exist no thorough research of human equality theoretical and practical problems but only fragmentary attempts in Lithuanian legal literature. There are the problem of the approach of the equality and inequality of different people, according to who, from what point of view and according to what criteria treats it, discussed in this article estimating the steady way of thinking critically. There is also studied if the state intervention to safeguard the particular level of the human equality is justifiable, what results from such intervention could be legitimate and might the illegitimate objects cause negative results.
