Summary/Abstract: Deviation of the aviation into two functional areas: civilian aviation and state aviation follows current international regulations. The basic legal document for civilian aviation operations is Chicago Convention from the December the 7th 1944. Despite the fact that civilian aviation can apply all regulations currently implemented, the state aviation has some significant problems in some areas of its implementation. Legal issues are not the only ones. The training and control systems are different and not based on the same regulations. Only military aviation has coherent model of fl ight and maintenance personnel preparation, precise aviation regulations in addition. The author and his proposals included in the article are related to the problems of the functionality of the state aviation in the following areas: aviation law, state aviation authority and training model for flight and maintenance personnel.
