Summary/Abstract: In relation to the activity of the High Court of Cassation and Justice (the Panel regarding the appeal in the interest of the law), in November 2018, two judgments were published and they related to: Article 207(1) and (2) (“Verification of preventive measures in preliminary chamber proceedings”) of the New Code of Criminal Procedure and Article 96(3) (“Court of Appeal”), Article 97(1) (“High Court of Cassation and Justice”), Article 483 (“Subject and purpose of the appeals. Competent court”) New Code of Criminal Procedure. In relation to the activity of the High Court of Cassation and Justice (the Panel regarding the settlement of certain legal matters), in November 2018, several judgments were published in the Official Gazette of Romania and they related to: Article 43(1) and (5) (“Penalties for repeat offences”) of the New Criminal Code, Article 169(1) (“Effects of rightful or judicial rehabilitation”) and Article 189(1)(e) (“First-degree murder”) of the New Criminal Code, certain provisions in Law No 85/2014 on insolvency and certain provisions of the Implementing Rules related to the provisions on the award of public procurement contracts/ framework contracts in Law No 98/2016 on public procurement.
