Summary/Abstract: The present work aims to be a reflection upon the role held by the public administration in the complex process of protecting the minors’ rights within a democratic society into which they might be the willingful or not witnesses of polemic disputes arisen between some people which do sustain certain opinions as a consequence of exerting their own rights issued from the freedom of conscience and the religious freedom. The importance of this theme does exist due to the psychological and physical features of the minors, to their aptitude of adopting some behaviours through imitation and to their natural need of feeling protected and safe. Another ground for approaching this theme is constituted by the strategical importance of children and young people for the future of the country. Thus some questions do naturally arise: to what extent might or not be revaluated the freedom of conscience and the religious freedom in respect to the minors’rights and through what means the public administration could take some actions in order to prevent an excessive practice of the freedom of conscience as well as the possible lacks in the due respect of the minors’rights? The present work does rely upon the analysis of the current legal frame and it does as well contain some de lege ferenda suggestions.
