Summary/Abstract: The purpose of this article is to compare constitutional regulations of marriage in Polish and Spanish legal systems. Both Polish and Spanish Constitutions emphasise the difference of sex between spouses and define marriage as a relationship between man and woman. Despite this, same-sex marriage has been legal in Spain since 2003, wheareas in Poland no regulations have been implemented in this area until now.
