ALTERNATIVE MEASURES AND SANCTIONS FOR JUVENILES

Summary/Abstract: From the standpoint of contemporary criminal policies, the essence of the application of these policies is to implement successful prevention programs, whose application primarily depends on the demonstrated subjective and objective factors of the minor’s personality. Given that certain principles are based on the idea of preventive action and that punishment of minors is the last resort in the suppression of socially dangerous behavior, the observance of the envisaged principles is most pronounced in the protective and guaranty function of criminal law. In that regard, various reactions of the community to the behavior of minors indicate that contemporary trends of criminal policy find their place in the application of alternative criminal sanctions and measures. Thus, instead of conducting a classic criminal procedure, states use various forms of social response in view of resolving and removing negative consequences caused by juveniles. In the contemporary criminal law theory, two basic models are usually distinguished: the welfare model and the justice model, which are mutually opposed by many normative solutions. The restorative justice model and neo-correctionalism appear as subspecies of the previous two models. Thus, a lex specialis, the Act on Juvenile Criminal Offenders and Criminal-law Protection of Juveniles (hereinafter: the Juvenile Justice Act) prescribes that the criminal status of minors is primarily related to the use of measures of diversionary character, in full observance of the basic human rights and freedoms and with the aim of acting in the best interest of juveniles.
