Summary/Abstract: The author first points out that the phenomenon of hate crimes has roots in ancient times. In the contemporary world, the social reaction against hate crimes may be traced back to the 1960s and the 1970s, when countries around the world began to implement the so-called concept of retributive justice to cases involving hate crimes. Lately, individual criminologists have been arguing for the application of the concept of restorative justice in hate crime cases. Starting from these tendencies, the author discusses the two models of restorative justice: the diversion model and the therapeutic model, and on the basis of existing legislation, elaborates on the possible implementation of each of these models in the Republic of Serbia.
