Summary/Abstract: At present the components of the national banking system are the credit institutions (private law entities) and the National Bank of Romania (independent public institution), this structure being reached after numerous legal changes. Regarding the legal regime of the credit institutions, Romanian legal entities, this could not have remained uninfluenced by the publicity of the banking law. Therefore, one of the reference points for the public intervention within credit institutions is the competence of the National Bank of Romania itself to ensure the financial stability by authorizing, regulating and prudential supervising the credit institutions. The state’s intervention through the national central bank is determined by the need to protect the public interest. Keeping under surveillance the entire legal existence of any credit institution, Romanian legal entity is achieved this way.
