Summary/Abstract: The article analyzes the actio rei vindicatio from co-owner against a person, which is not a coowner. The opinions in the theory and in court practice are resumed. The author thesis is that the co-owner has a right to vindicate not only his part of co-owner property, but the whole property. In the article are used dogmatic, comparative and teleological methods.
