Summary/Abstract: In this article, the main crimes committed against children by the main actors in his life were submitted to a careful analysis. Through legislation, namely the criminal code, as well as the Romanian Constitution, was consecrated the positive obligation of the State to protect children in difficulty, that is, those children who do not benefit from sufficient conditions required to ensure development and physical and mental integrity.
