Summary/Abstract: The access of public authorities to electronic communications is an interference with the fundamental right to respect for private life, enshrined in art. 7 of the Charter, even in the absence of circumstances which make it possible to classify such an interference as "serious" and irrelevant if the information relating to privacy is of a sensitive nature or if the persons concerned have suffered any inconvenience as a result of that interference . However, access by public authorities to data aimed at identifying owners of SIM cards activated with a stolen mobile phone such as their surnames, first names and, where appropriate, address to these owners implies an interference with the fundamental rights of the latter, the articles referred to in the Charter of Fundamental Rights are not so serious that they need to be limited, in terms of prevention, investigation, detection and prosecution of criminal offenses, to the fight against serious crime.
