Summary/Abstract: The aforementioned Horacio’s saying signified a heroic venture resulting in poor outcomes. Thus, although the implementation of the Consumer Bankruptcy Act initially seemed as a “heroic” venture, on the practical and empirical level, we see that many relationships in life are subject to different laws, primarily economic, and therefore cannot be changed by adopting regulations that are contrary to these laws. Therefore, taking into account the impact that the Consumer Bankruptcy Act has on over-indebted individuals and the society as a whole, the author will analyse the results of the two-year application of this Act. For the purpose of comparing and suggesting de lege ferenda for the Serbian legislator, the analysis of the Croatian experiences and the consumer bankruptcy procedure is important because it indicates whether the potential implementation and application of such insolvency model will achieve its purpose and give (expected) results.
