Summary/Abstract: The author of the article compares the institution of actio Pauliana in two different European legal systems: Polish and German. Analyzing particular prerequisites of applying this action, the author shows the similarities and differences between aforementioned legal systems. The main aim of actio Pauliana remains the same in both Polish and German law. It is the creditor protection against insolvency of the debtor, who leads his assets to the state, which endangers satisfaction of the creditor. In Polish law actio Pauliana is set forth in articles 527-534 of the Civil Code; in Germany – in the separate statute called “ustawa zaczepna” in Polish doctrine (Anfechtungsgesetz). One of the most important differences is the adoption of two different theories of suability, which results in certain and serious legal consequences. The significant distinctiveness are connected with the legal character of the claim, the subject of protection and separate prerequisites, which in German law comprise of both substantive and procedural ones.
