Summary/Abstract: The word cyberspace poses problems with regard to the concept of jurisdiction: it is a space inducive to the perpetration of crimes and offenses. The fact that it is a virtual space that functions and is used all over the world means, on one hand, that offenses are difficult to be detected by national or international authorities and, on the other hand, that even if they are detected, it is always difficult to judge and prosecute them if stqte soverignity is taken into account. Irrespective of the theoretical background used (the theory of effects, territoriality, universality etc.), they all present gaps.
