Summary/Abstract: The social model of disability, which focuses on determining the reasons for disabilities not connected with the individual as such, but pointing at the social barriers that limit the individual in the environment where he/she lives, is consistent with the assumptions of the UN Convention on the Rights of Persons with Disabilities and is a coherent and complementary element of the concept of individual vulnerability attributed to people who are marginalised in a given society. Since the EU is a party to the aforementioned Convention, while the provisions of the ECHR should introduce the minimum standard of protection of fundamental rights in the EU, it should be determined whether the legislative standard set by the Convention has been implemented in a binding manner at the level of EU law and ECHR.
