Summary/Abstract: The article deals with the matter of foster care, which is one of the legal institutes of the system of the substitutional family care in the Czech Republic and its current controversial points. The statutory wording of the foster care institute reflects the endeavours of the Czech Republic to decrease the number of children raised within institutional care, and to facilitate substitutional family care to children which are not brought up by their own parents
