Summary/Abstract: Starting March 2011, the world faces the largest humanitarian and refugee crisis, the Syrian refugee crisis. The conflict in Syria became the world’s largest producer of refugees, 5.6 million. The world responded by offering humanitarian assistance and international protection to those who were in need of it, however there were incidents in which terrorists have falsely represented themselves as people seeking international protection and sought or been granted asylum before being implicated in terrorist attacks or in foiled attacks. The paper analyzes the European and national legislative solution to tackle the issue of foreign terrorist fighters. At European level, Additional Protocol to the Council of Europe Convention on the Prevention of Terrorism, Council of Europe and Directive (EU) 2017/541 of the European Parliament and of the Council of 15 March 2017 on combating terrorism and replacing Council Framework Decision 2002/475/JHA and amending Council Decision 2005/671/JHA offer support and guidance regarding the issue of travelling abroad for the purpose of terrorism. In Romania, the issue is tackled by Law no. 535/2004 on preventing and combating terrorism, which incriminates travelling abroad for the purpose of terrorism in article 351. Lastly, considering that there were incidents in which terrorists have falsely represented themselves as people seeking international protection and sought or been granted asylum before being implicated in terrorist attacks or in foiled attacks, furthermore taking into account the fact that the conflict in Syria became the world’s largest producer of refugees, the paper, with respect for human rights, examines data regarding Syrian first time asylum applicants for international protection in Romania between March 2011 and September 2017, as well as the asylum grant rates of Romania and the United States.
