The Idea of an Implicit Social Contract

Summary/Abstract: The theory of an implicit social contract defines as legitimate such a political order in which its citizens have the possibility to express their consent, or to criticize it, or to emigrate. It constitutes a normative political theory for an assessment of the legitimacy of rules and the obedience of citizens. Contrary to other contract theories it establishes two criteria: that of the genuine, continuously renewed consent of living citizens, and that of this consent being implicit, and not explicit. Implicitness comprises the unexpressed agreement with a liberal order, if no resistance or criticism is manifested.
