Overview of the decisions of the Polish Supreme Court

Summary/Abstract: The Supreme Court took a stance on the legal status of assistant judges [Polish: asesor sądowy] in the civil procedure. The Court ruled that a rectification in the land register may be subject to an appeal, and not by way of taking an action against the decision of the court clerk. Furthermore, the Supreme Court resolved a dispute concerning significant doubts as to the limitation period for punishability of a criminal offense, where one act meets the characteristics of at least two types of prohibited activities described in the Criminal Act Law (joint compliance of provisions – Article 11 of the Polish Criminal Code). In addition, the Supreme Court issued a decision on the principle that a retired person has the right to recalculate their pension.
