Summary/Abstract: The study performs an analysis of the offence of carrying out of financial operations fraudulently, provided by the Article 250 of the Romanian Criminal Code. When performing the analysis of the offence of carrying out of financial operations fraudulently, it were taken into account the text in force of the offence of carrying out of financial operations fraudulently, provided by the Article 250 of the Romanian Criminal Code, the provisions of the Article 2 and of the Article 4 from the Council Framework Decision 2001/413/JAI of 28 May 2001 on combating fraud and counterfeiting of non-cash means of payment, the provisions of the Article 3 of the the Directive 2014/62/EU of the European Parliament and of the Council of 15 May 2014 on the protection of the euro and other currencies against counterfeiting by criminal law and replacing Council Framework Decision 2000/383/JHA and the provisions from the Proposal for a Directive of the European Parliament and of the Council on combating fraud and counterfeiting of non-cash means of payment and replacing Council Framework Decision 2001/413/JHA. The analysis aims to determine whether the texts of the Council Framework Decision 2001/413/JAI on combating fraud and counterfeiting of non-cash means of payment and of the Directive 2014/62/EU on the protection of the euro and other currencies against counterfeiting by criminal law were transposed in the Article 250 of the Romanian Criminal Code.
