Summary/Abstract: The sketch of hardship clauses acquired new contours under the brush of the constitutional judge and continues to finalize under the touch of the judgements made by the European Court of Justice. The key landmarks in our inquiry are the special relation between hardship and abusive clauses, the static and dynamic of the „hardship – abusive clauses” binome, as well as exerting the judge’s power to intervene on the architecture of credit contracts between consumers and traders based on hardship.
