Summary/Abstract: The present article offers a brief analysis of the electoral system established under national and EU law for electing the Members of the European Parliament, underlining the need of legal security for election rules. It presents the common provisions in force at European level for electing MEPs and the differences adopted by member states with regard to the electoral threshold, methods used for seat distribution, European Parliament constituencies, use of compulsory voting etc. It analyses the national legal framework for European Parliament elections and highlights a series of flaws in the Romanian electoral system which would need to be addressed in accordance with Code of Good Practice in Electoral Matters adopted by the Council of Europe through the Venice Commission.
