Summary/Abstract: The article analyzes the protection of human rights heretofore provided by the international law. The author carried out a research of the systems guaranteeing fundamental rights. Herein, it is indicated what the fourth generation of human rights shall encompass and its significance against the present system is analyzed. Advantages and disadvantages of the proposed solutions are discussed, referring directly to the theory of human rights protection. The conclusion contains a response to the question whether or not the concept of juridization of human rights is necessary and whether it shall prove rather harmful than beneficial.
