Summary/Abstract: The health condition factor is one of the key aspects influencing migration. On the one hand, it determines whether a foreigner is going to be willing or able to leave the country of origin. On the other hand, it also plays a role in foreigner’s return to his or her homeland. In cases of seriously ill foreigners, it is even necessary to consider whether their forced expulsion or failure to provide international protection may constitute a violation of the principle of non-refoulement. This paper attempts to analyze developments in the case law of the European Court of Human Rights, the Court of Justice of the European Union and the Supreme Administrative Court on this issue.
