Criminal Liability for the Misappropriation of Public Property in the Context of Exercise of Official Authority

Summary/Abstract: The article deals with criminal liability for improper disposition of public property by official person. With particular reference to the situation in the municipal government, authors try to distinguish the cases in which should be applied criminal liability solely for property offense and cases where official person should bear liability concurrently for or separately for criminal offense of abuse of power. Their reasoning is illustrated by some Supreme Court decisions.
