Summary/Abstract: The paper deals with the use of a methodology for examining the constitutionality of restrictions on economic, social and cultural rights and fundamental freedoms. The author reacts on the uncertainty of the methodology used by the Constitutional Court of the Slovak Republic which uses both a non-strict version of the proportionality test and a specific rationality test transposed from the Constitutional Court of the Czech Republic.
