Effective Sanction Policy – Trends and Limits

Summary/Abstract: The article deals with current trends in the field of imposing punishments and application of diversions with elements of restorative justice in criminal proceedings in the Czech Republic and also in regions of the Czech Republic. Factors which have an influence on sanction policy, especially the factors which can limit the principle of individualization of sanctions and application of diversions with elements of restorative justice, are also discussed. Attention is paid especially to development of structure of alternative sanctions and short term unconditional sentence of imprisonment in the connection with reform of criminal substantive law and further changes of Criminal code, Amnesty of president of the Czech Republic in 2013, but also to influence of imposing sanctions by criminal orders. Some problems in criminal proceedings which can reduce broader application of diversions with restorative elements are mentioned.
