Summary/Abstract: The subject of gloss on the judgment of the Supreme Administrative Court, ref. II OSK 1698/12, there is the issue of establishing a party in the proceedings for the annulment of the decision on the use permit for the building. In the opinion of the Supreme Administrative Court, the procedure of extraordinary proceedings in this case can not be limited only to the possibility of initiating proceedings by the investor.
